Overview

Brandon Schuelke is an experienced litigator in Griffith Davison’s Fort Worth office. Brandon’s practice focuses on all aspects of civil litigation and arbitration in connection with construction, real estate, and commercial business disputes. Brandon brings a unique understanding of the construction industry to his practice because of his background working as a project engineer for an international general contractor. Additionally, Brandon holds a Master of Science in Bioengineering from Texas Tech University.

Brandon helps his clients resolve complex disputes, devising legally innovative and practical solutions. Brandon takes a hands-on, detail-oriented approach to accomplishing client goals and objectives throughout the dispute process.

Outside of work, Brandon enjoys spending time with his wife, newborn son, and dog, Gemma. Brandon is avid sports fan, cheering for all things Texas Tech and Dallas-Fort Worth professional sports teams.

 

CONSTRUCTION LITIGATION REPRESENTATION

Represented a national general contractor in a complex construction litigation dispute against a roofing subcontractor involving water penetration and water damage to a 180-unit condominium complex resulting in a settlement over $500,000 at mediation.
Represented a national general contractor against a plumbing subcontractor involving severe plumbing defects and deficiencies causing over $1,000,000 in damages to a 180-unit condominium complex currently in arbitration.
Represented a homeowner against a contractor, engineer, and engineering firm involvingconstruction defects to the foundation resulting in a settlement over $400,000 at mediation.
Represented multiple homeowners in disputes against contractors and subcontractors under the Residential Construction Liability Act.

REAL ESTATE LITIGATION REPRESENTATION

Represented a real estate developer in arbitration obtaining a favorable verdict to reform a deed after a mutual mistake wherein the client accidentally deeded more than what was purchased under the real estate purchase agreement.
Represented a real estate developer/contractor against claims for breach of contract obtaining a favorable settlement at mediation after striking the plaintiffs’ evidence of damages.
Obtained a $1,000,000 jury verdict in federal district court representing clients in a breach of contract claim involving the purchase of a business and real estate.

COMMERCIAL LITIGATION REPRESENTATION

Successfully defended a client against an assault claim while obtaining a jury verdict for 100% of damages on a breach of contract counterclaim resulting in a favorable settlement after the jury verdict.
Represented a dentist in a partnership dispute defending against malpractice claims resulting in a favorable settlement after drafting and filing a motion to dismiss pursuant to Texas Civil Practice and Remedies Code Section 74.351.
Successfully used Texas Rule of Civil Procedure 167 to offset an unjust jury verdict against after multiple successful post-verdict motions attacking the verdict on evidentiary grounds.
Defended a restaurant owner from breach of contract claims due to impossibility of performance, impracticability of performance, and frustration of purpose resulting from the COVID-19 pandemic; assisted in the negotiation of a settlement for 11% of alleged damages in one such case.
Represented an oil and gas trucking company in a breach of contract claim for unpaid work resulting in summary judgment for 100% of claimed damages.
Negotiated favorable settlement while defending a business client’s fair use of a trademark because it was not used in bad faith and there was no confusion amongst consumers.
